Santa Fe, Salta Advance Digital Law Push
Santa Fe passed the Ema Law, while Salta opened debate on digital gambling. A national bill also targets AI-enabled crimes.
Santa Fe became the first Argentine province with a specific legal framework against digital violence in schools after passing the Ema Law. At the same time, Salta opened debate on a bill addressing digital gambling and cyber betting, while Congress moves ahead on a proposal to update several laws for crimes committed with artificial intelligence.
Santa Fe passed the Ema Law and became the first Argentine province with a specific legal framework against digital violence in school settings. The law creates the Provincial System for the Prevention and Comprehensive Approach to Digital Violence in Educational Settings, and was promoted by provincial lawmaker Celia Arena. According to the information released, it is designed to prevent and address harassment and other forms of digital abuse in educational institutions, including the spread of intimate content and cyberbullying.
Santa Fe: the Ema Law is now approved
The provincial legislature gave final approval to the law, which had also been introduced at the national level and in Buenos Aires province, where it still has not received a committee report in the lower house. With the vote in Santa Fe, that jurisdiction became the first in the country with a specific rule for this kind of violence in schools, while the matching bills at the national level and in Buenos Aires remain in committee.
Ecos365, in a report on how it would be applied, described the Ema Law as a tool for dealing with digital violence cases within the education system, with a structure aimed at implementation in schools.
Salta opens debate on digital gambling
In Salta, bill No. 90-34.492/2026 was introduced under the formal title of a bill for the "Prevention, comprehensive approach, protection and technical and health assistance in the face of gambling addiction." The text adds prevention, comprehensive response, protection and technical and health assistance in relation to digital gambling addiction, cyber betting, and compulsive use of gambling and interactive platforms by minors and young people up to age 21.
The bill, which has not yet been approved, also provides for the possibility of seeking a court order to block domains and IP addresses across the province for unauthorized or infringing sites or apps tied to gambling and digital interactive platforms. The proposal also calls for coordination among health, education and justice authorities for implementation.
Artificial intelligence and crimes: national bill
At the national level, a group of deputies introduced an initiative to amend the Civil and Commercial Code, the Penal Code and Law 26.485 in order to add specific references to the use of artificial intelligence when that technology is used to commit crimes or violate rights protected under Argentine law. The bill was formally introduced in the Chamber of Deputies and referred to the committees on General Legislation and Criminal Legislation.
The proposal was sponsored by Deputy Pamela Verasay and other lawmakers, but it does not create a comprehensive AI law or impose obligations on developers or providers. Its focus is on defining and increasing penalties for crimes committed through AI, such as scams involving cloned voices, forged documents or simulated identities.
Mendoza: debate over cybersecurity remains open
In Mendoza, debate over the Cybersecurity Law continues to draw criticism from experts and institutional actors. While they support the need for a law, they question the lack of clarity in the text, the closed nature of the executive branch's proposal and the limited room to discuss key issues in the legislature.
According to the reporting, Minister Mercedes Rus appears to be the main political backer of the official initiative. At the same time, the Kirchnerist bloc introduced an alternative cybercrime bill focused on personal data protection, promoted by Senator Félix González and deputies Lidia Quintana and Lucas Ilardo.
