Brazil Suspends Discord Live Streams
Brazil’s ANPD has ordered Discord to pause Go Live until it proves stronger protections for children and teens after a teenager’s death.
Brazil’s data protection authority ordered Discord to suspend live streaming in the country and gave the company three business days to comply. The restriction remains in place until the platform shows effective controls to protect children and teenagers, in a case the regulator links to the death of a 13-year-old girl.
Brazil’s National Data Protection Authority, the ANPD, ordered Discord to suspend live streaming in the country through a preventive measure issued on August 12, 2026. The company was given three business days to comply, and the restriction covers Go Live and equivalent livestreaming tools.
Scope of the order
The ANPD’s order says the suspension must remain in place until Discord proves it has adopted effective measures to protect children and adolescents while using the platform. The agency’s official statement says reactivation will depend on explicit authorization from the ANPD itself, after it verifies technical, security, and governance measures aimed at protecting minors.
Later coverage clarified that the block does not affect Discord as a whole. Text messages and voice channels remain active, while real-time video streaming is subject to suspension and later authorization. Insight News also said the order covers other forms of live transmission and screen sharing, expanding its practical reach over streaming features.
Regulatory background and penalties
According to a technical analysis, the ANPD opened an enforcement proceeding on August 7, 2026, and the August 12 decision was based on articles from the so-called Digital ECA. That framework expanded the Brazilian regulator’s role in overseeing digital platforms, giving it authority to require child protection measures, apply sanctions, and order service suspension in cases of noncompliance.
Under that framework, various reports put the penalty risk at up to 50 million reais per violation. Reuters added that the company can appeal through two levels within the ANPD, with an initial 10-business-day deadline and possible review by the Board of Directors. O Globo, in its legal coverage, also said the regulator is considering a daily fine whose amount will be set during the sanction phase and, in the event of repeated noncompliance, the possibility of asking a court to suspend the service in Brazil entirely.
What the authority found
A leaked technical note reported by Metrópoles says Discord’s automated moderation and alert system failed to correctly classify a critical event involving a teenage girl. The document also points to the lack of robust mechanisms to detect and stop risky situations involving minors, and that was used as the technical basis for the preventive measure.
International coverage, including Reuters, Bloomberg, and Folha de S.Paulo, links the decision to the death of a 13-year-old girl, who was allegedly encouraged by other users to self-harm and die by suicide in streams carried out on the platform. The ANPD frames the case as a precedent for enforcement on child protection under the Digital ECA.
Discord’s response
The company’s official position, as reported by O Globo, was that the ANPD acted too early. Discord also rejected some of the government’s claims about the platform’s moderation capabilities and said it is cooperating with authorities. The case leaves the U.S. company under a regime in which even if it makes changes, those changes must be reviewed by the regulator before streaming can return in Brazil.
Baker McKenzie also noted that the ANPD had already been regulating transparency obligations for digital service providers under the Digital ECA, including the publication and submission of reports on online child and adolescent protection. DataPrivacyBR said this is the first time the ANPD has explicitly used those expanded powers against a major global platform, cementing a shift in its enforcement approach.
