Brazil’s ANPD probes Discord

The ANPD has opened a supervisory process against Discord to investigate signs of noncompliance with duties set out in the Digital ECA. According to O Globo, if irregularities are confirmed, the platform could face fines of up to R$ 50 million per violation.

Scope of the investigation

UOL Tilt reported that the opening of the case could lead to a warning, a fine of up to R$ 50 million, and, at a later stage, suspension of the service in Brazil. That reading broadens the enforcement exposure and places Discord under regulatory review with potentially direct operational consequences in the country.

UOL also noted that the ANPD is already authorized to monitor enforcement of the Digital ECA. In that context, the Discord case appears to be one of the first visible moves under an operational mandate that is expanding into active oversight of duties tied to the law.

What is at stake

For now, the confirmed fact is the opening of the supervisory process and the review of possible violations. The sanction range cited by both outlets runs from a warning to multimillion-real fines, with the possibility of a suspension of the service in Brazil if the case moves in that direction.
