Argentina Sets AI and Child Data Limits
Argentina’s MPF approved rules for AI use, while lawmakers advance bills to protect minors’ data on digital platforms.
Argentina’s Federal Public Prosecutor’s Office approved Resolution PGN 64/2026 with limits on artificial intelligence use, while several bills on protecting minors’ personal data on digital platforms remain under review in Congress. Among them is 1114-D-2026, which proposes an age-tiered framework and age-verification duties, with no vote yet.
Argentina’s Federal Public Prosecutor’s Office approved Resolution PGN 64/2026, while several bills aimed at protecting minors’ personal data on digital platforms continue to move through Congress. One of them, file 1114-D-2026, proposes an age-tiered framework, along with other measures that would set a digital age of majority and require age verification. None of the proposals has been voted on yet.
What did Resolution PGN 64/2026 establish?
The resolution set institutional guidelines for the use and deployment of artificial intelligence tools inside the Federal Public Prosecutor’s Office. It also banned the entry of restricted information, case data from ongoing proceedings, and personal or sensitive data into publicly accessible AI models. In addition, it ordered human oversight of the tools in use and a permanent AI training program for all staff.
The measure was registered nationally in Argentina by Blog del Contador, under Justice and Personal Data Protection, in the Artificial Intelligence category and the transparency and personal data protection program for AI use section. That classification underscores the formal link between AI governance and personal data safeguards in the public sector.
People of Internet also noted that the resolution bars decisions based exclusively on automated outputs. It requires specific training in prompt writing, bias detection, and result validation, and it calls for internal, secure AI environments as an alternative to commercial chatbots. According to that analysis, the measure partially fills the gap left by a national AI law that has not yet been approved.
What is happening with the bills on minors on platforms?
The bills introduced in 2026 seek to limit the processing of minors’ personal data on digital platforms, but all remain in parliamentary review and have not been voted on. Lexar said file 1114-D-2026 sets out an age-based framework, while other proposals aim to define the digital age of majority and impose age-verification requirements.
At the same time, Catamarca’s Public Defender’s Office asked SENAF and other national agencies to press Meta to apply in Argentina the same protections for minors it uses in the United States. The recommendation included age-verification checks to identify users under 18, removal of profiles for children under 13, and stronger parental supervision tools.
Literal.ar added another element to the debate by describing agreements reached with Meta that require alternative signals to identify accounts belonging to minors. Those signals include birthday references in posts, school data, images, interaction patterns, and links to other accounts, pushing the local debate beyond self-declared age.
How are these two fronts connected?
Together, the prosecutor’s office move and the bills on minors show that Argentina’s data protection debate is no longer limited to Law 25.326. On one side is the need to set concrete limits on AI use inside public agencies. On the other is pressure to establish age controls and stronger protections on digital platforms.
In that overlap, the MPF resolution creates immediate obligations for internal AI use, while Congress continues to debate how to adapt minors’ data protection to platform environments. For now, the result is a landscape with active sector-specific rules and broader reforms still pending.
