Brazil Senate advances candidate data bill
Brazil’s Senate logged PL 5,648/2026 as pending, while PEC 17/2019 has already passed and gone to the lower house.
Brazil’s Senate has logged PL 5,648/2026 as pending, while PEC 17/2019 has already cleared the plenary and been sent to the Chamber of Deputies. The candidate-focused proposal would allow access to banking, phone and messaging data under certain conditions.
Brazil’s Senate has registered Bill 5,648/2026 as pending. Under the official summary, the measure would allow electoral authorities to access the financial records of candidates, their spouses or partners, along with call logs and messages, if they authorize it. The bill is listed with its latest status as "awaiting dispatch" in the Senate plenary.
What does PL 5,648/2026 include?
According to Brazil’s Federal Senate, the proposal would cover financial information from the previous five years, call and message records, and, for internet communication services, data from the prior six months. The official summary also says the measure would require authorization from candidates, spouses or partners.
Information released by the Senate also says the bill was introduced by Senator Randolfe. Independent reporting from Congresso em Foco adds that the proposal would also apply to the candidate’s spouse or partner and that, if the candidate is elected, new authorizations would be required to continue monitoring data during the term of office.
What happened to PEC 17/2019?
PEC 17/2019 was approved by the Senate plenary and sent to the Chamber of Deputies, according to the official record from Brazil’s Senate. The proposal seeks to add personal data protection to the list of fundamental rights and to give the Union exclusive authority to legislate on the matter.
The coexistence of both measures leaves two tracks open in Brazil’s Congress. One is a constitutional reform now in the Chamber of Deputies. The other is a bill moving through the Senate that would expand access to financial and phone data in the electoral process.
