Brazil’s ANPD opens complaints channel
ANPD opened an online channel for complaints about possible breaches of Internet Civil Framework decrees and will use them in enforcement.
Brazil’s ANPD has launched a dedicated page to receive online complaints about possible breaches of Decrees 12.975/2026 and 12.976/2026, tied to updates to Internet Civil Framework regulation. The information collected will guide monitoring, enforcement and possible investigations by the agency.
Brazil’s ANPD has launched a dedicated page to receive online complaints about possible breaches of Decrees No. 12.975/2026 and No. 12.976/2026, tied to updates to the regulation of Brazil’s Internet Civil Framework. The agency said the information it receives will help guide monitoring, enforcement and possible investigations.
What can the new channel be used to report?
The channel accepts reports of possible violations related to obligations under the Internet Civil Framework, as well as the Statute of Children and Adolescents in the Digital Environment. According to Gazeta do Povo, both individuals and companies can submit complaints.
UOL said the tool is aimed at social networks, apps and other digital platforms. Examples of possible violations include the absence of channels to report unlawful content, failures to stop ads or promotion of that content, no legal representative in Brazil, and missed takedown deadlines.
What changed with Decrees 12.975 and 12.976?
Decree No. 12.975/2026 set out platform duties on transparency, risk prevention and mitigation, and the fight against online fraud and scams. Decree No. 12.976/2026, according to UOL, established specific guidelines to protect women from forms of digital violence, including intimate content created, altered or shared through digital technologies and artificial intelligence.
Together, the two decrees expand the compliance burden for companies operating digital services in Brazil. In practice, the complaints channel gives ANPD another way to receive indicators of implementation failures that could lead to regulatory follow-up.
How does it connect to the review of the enforcement rules?
The new page comes alongside a public consultation on revising ANPD’s enforcement rules and administrative sanctioning process, which began on September 9, 2026 and remains open for contributions until October 26, according to FCM Law. That process will define how the agency investigates and applies sanctions in the years ahead.
FCM Law said the review will affect how ANPD conducts investigations and applies penalties. Migalhas, in an analysis of the Discord case, linked the public hearing to the discussion of precautionary measures and focused on how the future rule will treat those measures before they become sanctions.
For companies subject to Brazil’s LGPD and the Internet Civil Framework, the situation combines greater exposure to complaints with a revised enforcement standard. That means reviewing reporting channels, internal procedures for handling complaints, and compliance design for both new and existing obligations.
